Terms of Service

These terms govern your use of CodifyNest - the moderation API, the developer console, and this website. We have kept them as short and readable as we can, because terms nobody reads protect nobody.

01Acceptance of terms

By creating an account, generating an API key, or calling the CodifyNest API, you agree to these terms. If you are agreeing on behalf of a company, you confirm you have authority to bind that company. If you do not agree, do not use the service.

02The service

CodifyNest provides an API that classifies content and returns a moderation verdict, along with a console for managing keys, policies, usage, and billing.

The service is a classification tool, not a guarantee and not a substitute for your own judgement. Moderation is inherently probabilistic. It will sometimes flag acceptable content and sometimes miss unacceptable content. You remain responsible for the content on your platform and for the decisions you make with our output.

03Accounts and API keys

  • You must provide accurate account information and keep it current.
  • You are responsible for keeping your API keys secret, and for all activity under them. Treat a key like a password: never ship it in client-side code.
  • Tell us promptly if you suspect a key has leaked. You can revoke and rotate keys at any time in the console.
  • One person or entity per account. Do not share credentials across organisations.

04Acceptable use

You agree not to use CodifyNest to:

  • Break any applicable law or regulation.
  • Build surveillance or profiling systems targeting individuals or groups on the basis of protected characteristics.
  • Reverse engineer, resell, or repackage the service as a competing moderation API.
  • Circumvent credit limits, rate limits, or billing - including by distributing calls across accounts to avoid a plan limit.
  • Submit content you have no lawful right to process, or that violates the privacy rights of the people it concerns.
  • Probe, load-test, or attack the infrastructure without our prior written consent.

We may suspend an account that materially breaches this section. Where the breach is not severe or repeated, we will contact you first.

05Credits and billing

  • One credit equals one moderation call. Batch requests cost one credit per item.
  • Credits reset monthly and do not roll over.
  • Paid plans bill monthly in advance. Overage is billed in arrears.
  • If you exceed your plan allowance, requests continue and are billed as overage, so moderation does not fail open on you. You can set a hard cap in the console instead.
  • You can cancel any time; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.
  • We may change pricing with 30 days' notice to existing customers. Continuing to use the service after that constitutes acceptance.

06Your content

You retain all rights to the content you submit. You grant us a limited licence to process it solely to provide the service - that is, to return a verdict and, if you enable logging, to store it for the retention window you choose.

We do not train models on your content. See the Privacy Policy for how content is handled.

You are responsible for having a lawful basis to send us the content you send, and for telling your own users what your platform does with theirs.

07Availability and support

We work hard to keep CodifyNest available and publish live status and incident history at status.codifynest.com. Growth and Enterprise plans include a 99.9% uptime SLA; other plans are provided on a commercially reasonable efforts basis.

We may change or discontinue features. For breaking changes to the API, we will version the endpoint and give reasonable notice before retiring an older version.

08Disclaimer of warranties

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that moderation verdicts will be accurate in every case.

09Limitation of liability

To the maximum extent permitted by law, CodifyNest is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.

Our total aggregate liability arising out of or relating to the service is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim.

Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

10Termination

You may close your account at any time from the console. We may suspend or terminate access for material breach of these terms, non-payment, or where required by law - with notice where circumstances reasonably allow. On termination your right to use the service ends immediately, and we will delete your data in line with the retention terms in the Privacy Policy.

11Changes to these terms

We may update these terms as the service evolves. For material changes we will notify account holders by email before they take effect. Continuing to use the service after that means you accept the revised terms. The date at the top of this page always reflects the current version.
